The MP 38 and MP 40 (MP designates Maschinenpistole, literally "Machine Pistol") is a sub-machine gun developed in Nazi Germany and used extensively by paratroopers, tank crews, platoon and squad leaders, and other troops during World War II. The MP 40 was characterized by its low rate of fire (535 RPM) and low recoil.

The MP-40 appears in Mafia II, it made its first appearance during The Old Country being armed by Mussolini's Axis Forces. It can be bought at Harry's Shop from chapter 9 onwards, although it could be obtained in the earlier chapter if the player kills the bartender at the Hill of Tara, since it is an automatic weapon police will try to arrest Vito if they see him using one because civilians can't use weapons in public.
The MP-40 is one of the more accurate automatic weapons in the game but has a slower rate of fire than other guns including the Thompson 1928 and Thompson M1A1,it holds 96 rounds in reserve (3 Reserve 32 round magazines).
